This is an agreement between you ('You/User') and Ishi Luxe Co (hereinafter referred to as (Ishi luxe). These Terms of Use ('Terms') govern your access to and use of https://ishiluxe.in ('Website').

By accessing and/or using the Website, You agree to be bound by these Terms. The Terms may be updated by Ishi Luxe from time to time without notice.

1. ELIGIBILITY

1.1 The Website is only to be accessed and/or used by persons who are competent to contract under laws in force in India.

1.2 Notwithstanding the above, minors, i.e., persons below the age of 18, and persons with disability, can only access and/or use the Website when under the supervision and/or with prior permission of, a parent and/or such legal guardian.

1.3 By using/accessing the Website, You represent and warrant that you meet the eligibility requirement.

2. ACCOUNT REGISTRATION

2.1 To access certain features and/or place your orders on the Website, you will be required to create an account. You agree to:

2.1.1 Provide accurate, current, and complete information during the registration process.

2.1.2 Maintain and promptly update your account information to keep it accurate, current, and complete.

2.1.3 Maintain the security and confidentiality of your account credentials.

2.1.4 Notify us immediately of any unauthorized use of your account or any other type of breach of any manner.

3. USER CONDUCT

3.1 You agree not to use the Website for any unlawful or prohibited purpose, including but not limited to:

3.1.1 Violating any applicable laws and/or regulations; and/or

3.1.2 Infringing rights of third parties, including their intellectual property rights; and/or

3.1.3 Posting or transmitting any false, misleading, or fraudulent information; and/or

3.1.4 Engaging in any conduct which disrupts and/or interferes with the operation of the Website.

4. INTELLECTUAL PROPERTY

4.1 All intellectual property, which includes but is not limited to logo, symbol, trademarks, artwork, content (collectively "Intellectual Property") displayed on the Website are intellectual property of Ishi luxe and its affiliates.

4.2 Any information and the Intellectual Property on the Website shall not be copied, downloaded, reproduced, re-posted, transmitted, displayed, distributed, rented, sublicensed, altered, stored for subsequent use, or otherwise used in whole or in part in any manner without the prior written consent of Ishi Luxe.

5. LINKS TO THIRD-PARTY SITES

5.1 The links available on the Website, which redirect the User to other third-party websites, are not under the control of Ishi Luxe and Ishi Luxe is not responsible for any loss suffered by you and makes no representations or warranties concerning the contents of any linked site and/or any link contained in a linked site.

5.2 Ishi Luxe provides third-party links only for convenience and the inclusion of any link does not imply endorsement, investigation, or verification by Ishi Luxe of the linked site. In case the User decides to access any of the third-party sites linked to this Website, the same will be done at the User's own risk and liability.

5.3 Ishi Luxe reserves the right to terminate any link or linking program at any time. There may be circumstances where access to this Website is provided by a hypertext link located at another website. However, Ishi Luxe does not make any representations or give any warranties with respect to any information contained in or at these other sites and Ishi Luxe shall not be liable for any damages or injury arising from the content of these other sites.

6. POLICIES

The following terms are hereby incorporated in these Terms of Use:

6.1 Cancelation Policy

If you wish to cancel your order, you can do so by sending us an email on customercare@ishiluxe.in within 24 hours of placing the order. You can also call our Customer Care on +91-9217120100 (Timings: 9:30 am - 5:30 pm IST), within 24 hours of placing the order. Once orders have been dispatched, they cannot be cancelled. In case of cancellation of the order within the timeline, you will be charged 3.5% as payment gateway charges and the balance will be refunded to the cardholder and credited through the same payment instrument in 7-10 working days or as per the Bank’s guidelines.

6.2 Cash on Delivery Policy

  • We have the option for ‘Cash on Delivery’ on orders worth INR 1000 to INR 5000 for domestic orders only. We follow all safety protocols, along with our courier partners, to ensure the package that reaches you is safe.
  • If you are physically unavailable for during the time of delivery, please suggest an alternative address or contact number of a reliable source at customercare@ishiluxe.in within 48 hours of order placement, for successful delivery.
  • If a ‘COD’ order is returned to us due to your unavailability or any other reason, we will only reship the same order only if you convert it to a prepaid order, post-delivery failure.
  • Customers placing “COD” orders will be reached out via call for the confirmation of their orders. Customers failing to respond to the calls will be reached out via mail informing cancellation of the COD order. Customers may respond to the mail confirming the processing of the order.
  • If a customer refuses the delivery of a ‘COD’ order more than twice, he/she would not be eligible for ‘COD’ for all future orders. Then, he/she can only choose to place a prepaid order on the website.
  • All claims for shortages (missing items) or damages must be reported to our customer service team within 48 hours of delivery. We request you to write to us at customercare@ishiluxe.in well within the aforementioned time frame. Ishi Luxe Co will not be responsible for any claim raised with respect to damages or missing products post 48 hours of delivery.
  • Shipping/billing address can’t be changed once the order is placed. No modifications can be made post successful placement of orders. For further queries, you may get in touch with our Customer Care team on email at customercare@ishiluxe.in or chat with us from Monday to Friday, from 9:30-5:30 PM IST (barring Saturdays, Sundays and official holidays).
  • If a ‘COD’ order is to be cancelled, please inform our customer service team by sending an email at customercare@ishiluxe.in with the order number on the same date that you placed the order.
  • COD orders cannot be refunded in the original mode of payment. It can only be refunded via banking transaction.

6.3 Payment Security

  • All transactions at Forest Essentials Online are protected by SSL (Secure Sockets Layer) and Secure Data Encryption using a 1024-bit process. Any information you enter when transacting with Ishi Luxe
  • Co Online is sent in a Secure Socket Layer (SSL) session and is encrypted to protect you against unintentional disclosure to third parties. This is an assurance that we follow the best security practices adopted by major online vendor, where all payments are processed in real-time, for your security and immediate peace of mind.
  • You can tell if your browser is in secure mode at “Checkout”, by looking for the padlock icon at the bottom corner or at the end of the address bar of your browser window.

6.4 Out of stock Items

We apologize for the inconvenience this may cause. If your item is out of stock, we will contact you within 2 business days to discuss how you would like the order to be handled. Ishi Luxe Co Online does not back order, that is, we do not accept orders which we cannot fulfil immediately.

6.5 Return and Refund Policy

RETURN & REFUND POLICY (OPEN BOX DELIVERY)

This Return & Refund Policy applies to all purchases made from Ishi Luxe, including Pavishe and Sumishe. By placing an order, the customer agrees to the terms outlined below.

1. Open Box Delivery Requirement

All deliveries are conducted under our Open Box Delivery Policy. Customers must inspect the product in the presence of the delivery agent before accepting the order.

2. Conditions for Return (During Open Box Only)

A return is permitted only if the issue is identified during open box inspection. Valid reasons include:

  • Damaged or leaking product
  • Tampered or broken packaging
  • Incorrect product delivered
  • Missing items
  • Product appears used or defective

The delivery agent will document the issue and collect the product immediately.

3. Non Returnable After Acceptance

Once the customer accepts the product after inspection, no return or refund will be permitted. This includes:

  • Change of mind
  • Preference change
  • Allergic reactions
  • Claims raised after the delivery agent leaves
  • Opened or used products

For hygiene and safety, skincare and personal care items are non returnable once accepted.

4. Refund Eligibility & Process

Refunds apply only to orders rejected during open box delivery and verified by our Quality Team. Refund method:

  • Prepaid orders → original payment method
  • COD orders → bank transfer or wallet credit

Refund timeline: 5–7 business days after quality check.

5. Replacement Policy

Replacements are issued only after the returned product passes quality verification and are subject to stock availability.

  • Report issues immediately
  • Avoid accepting damaged or incorrect products

6.6 Pricing Policy

  • The product prices listed are current and updated. However, these are subject to change without advance notice.
  • All prices on this web site are processed in Indian Rupees and the prices are inclusive of all taxes.
  • All orders are acknowledged at current pricing. We will bill at the price in effect, at the time of shipping.
  • Our products are liable for GST in India.
  • All international shipping orders may attract local duties applicable in that country and the customer will have to pay locally, accordingly. We will not be able to confirm what these charges will be in advance and are not liable to pay these from our end.

6.7 Shipping Policy

Shipping Policy – Ishi Luxe Co At Ishi LUXE Co, we are committed to delivering your skincare essentials quickly, safely, and efficiently.

Order Processing Time
All orders are processed and dispatched within 24 to 48 hours (excluding weekends and public holidays) from the time of placing the order. You will receive a confirmation email with tracking details once your order has been shipped.

Delivery Timeline
Orders are typically delivered within 7 working days from the date of dispatch, depending on your location. Please note that deliveries to remote areas may take slightly longer.

Shipping Charges
We ship across India, except for a few remote locations. All domestic orders of INR 1000/- & above qualify for free domestic shipping. However, there is a flat shipping charge of INR. 150/- if your total order value is less INR. 1000/-.

Delivery Partners
We work with trusted courier partners to ensure your order reaches you safely and on time. You can track your order through the tracking link shared in your confirmation email.

Delays & Exceptions
While we strive to ensure timely delivery, occasional delays may occur due to factors beyond our control (weather conditions, logistical issues, or public holidays). In such cases, we will keep you informed.

7. ELECTRONIC CONTRACT

This document constitutes an electronic contract between the User and Ishi Luxe under the Information Technology Act, 2000.

8. CONSENT TO ELECTRONIC FORM OF THE TERMS OF USE

8.1 The User acknowledges and consents to the electronic form of these terms and conditions of use by accessing this Website and agrees that the Terms of Use, in printed or electronic form, shall be admissible in judicial and/or arbitration proceedings, to the same extent and subject to the same conditions as other documents and records generated and maintained in written form.

8.2 In case the User does not agree to the Terms of Use, the User should not access and/or use the Website.

9. WAIVER

No delay or omission by Ishi Luxe to exercise any right occurring upon any noncompliance on your part with respect to any of these Terms of Use shall impair any such right or power or be construed to be a waiver thereof. Any waiver by Ishi Luxe of any of the covenants, conditions, or agreements to be performed by the User shall not be construed to be a waiver of any succeeding breach thereof or of any covenant, condition, or agreement herein contained.

The User understands that product recommendations by Ishi Luxe may be provided by relying on artificial intelligence and therefore the suggestions may not be fully accurate. It is recommended that the User consult a dermatologist before deciding to use a product recommended by Ishi Luxe on the Website. The User also waives all rights to pursue remedies against Ishi Luxe for such product recommendations generated using artificial intelligence.

10. SURVIVAL

The provisions herein dealing directly or indirectly with intellectual property, compliance with laws and regulations, consent of the User, links to third parties, dispute resolution continue to apply and shall survive the termination or expiration of any relationship between the User and Ishi Luxe.

11. LIMITATION OF LIABILITY

11.1 Ishi Luxe shall not be held liable for any losses whatsoever arising from the use of and/or inability to use the Web Site and/or any of its features for any reason whatsoever which includes but is not limited to any loss of financial due to discontinuation of the loyalty program, any delay or failure or disruption of the content or services delivered through the Website, acts of God, forces or causes beyond its reasonable control, Internet and System failures, changes to or termination of any features on the Web Site or telecommunications or any other equipment failures, electrical power failures, strikes, labour disputes, riots, insurrections, civil disturbances, shortages of labour or materials, fires, flood, storms, explosions, natural calamities, war, governmental actions, orders of domestic or foreign courts or tribunals.

12. INDEMNIFICATION

The User hereby agrees to indemnify Ishi luxe from any and all losses, claims, liabilities which may arise from their use of the Website (including but not limited to the display of User's information on the Website) and/or from User's breach of any of these terms and/or the policies mentioned in Clause 6 hereinabove.

13. TERMINATION

13.1 Ishi Luxe reserves the right to terminate Your access to the Website, and/or certain areas or features of the Website, at any time without assigning any reason and with or without notice to you.

13.2 Ishi Luxe also reserves the right to take down the Website without any prior notice or explanation. Ishi luxe further reserves the right to limit, deny and/or provide different features to different User(s) of the Website, and/or to change any or all of the features of the Website and/or introduce new features without any prior notice to User(s).

13.3 Ishi luxe reserves the right to terminate the membership/subscription of any User(s) temporarily or permanently for any of the following reasons:

13.3.1 Engagement in illegal activities/transactions; and/or

13.3.2 Breach of any provisions of these terms of use, including but not limited to Clause 3.1 of these terms of use; and/or

13.3.3 In case the User is involved in unauthorized access, use, modification, or control of the Website database, network or related services.

13.3.4 Any unauthorized creation, generation, modification, alteration, hosting, displaying, uploading, publishing, transmitting, storing, updating, sharing or otherwise disseminating of modification of synthetically generated information (“SGI”) as defined under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code), Rules 2021 which is uploaded on the Website. Where such creation, generation, modification, alteration, hosting, displaying, uploading, publishing, transmitting, storing, updating, sharing or otherwise disseminating of modification of SGI is in contravention of any law in force, then the User who is responsible for such non- compliance may be liable to penalty or punishment under the provisions of any applicable law including but not limited to the provisions of the Information Technology Act, 2001, the Bharatiya Nyaya Sanhita, 2023, the Protection of Children from Sexual Offences Act, 2012, the Representation of the People Act, 1951, the Indecent Representation of Women (Prohibition) Act, 1986, the Sexual Harassment of Women at Workplace (Prevention, Prohibition And Redressal) Act, 2013, and the Immoral Traffic (Prevention) Act, 1956.

14. DISPUTE RESOLUTION

Any dispute and/or differences in interpretation of and/or in relation to the Terms of Use and/or the usage of the Website shall be governed by the laws of India and shall be subject to the sole jurisdiction of the appropriate court(s) in Delhi, India.
